The Difference Between Legal Custody And Physical Custody

Maryland law distinguishes between two types of custody, each serving different purposes for the family.

  • Legal custody: Legal custody provides for parental authority and decision-making for minor children in areas of significant decision affecting a child’s life such as schooling, medical care, faith-based instruction and other matters of significance. A judge can grant one parent exclusive decision-making power or require both parents to reach joint decisions. A parent may be awarded tie breaking authority when joint decision-making is awarded.
  • Physical custody: Physical custody provides for the living arrangements and time-sharing plan for each child and each parent. The physical custody terms for a child details the schedule of time a child spends with a parent, whether a primary residency, or the sharing of physical care. Holidays, vacation time and similar special days should be determined when addressing the physical custody of a child or children.

Courts determine custody arrangements based on the best interests of the child standard, evaluating factors like each parent’s fitness, the child’s relationship with each parent, the child’s age and needs, each parent’s ability to maintain stable home environments and the willingness of each parent to support the child’s relationship with the other parent.

Child Support Calculation And Guidelines

Maryland uses established guidelines to calculate child support obligations based on both parents’ incomes and the number of children. The guidelines consider gross income from all sources, work-related childcare expenses, health insurance costs and extraordinary medical expenses. The calculation of child support considers the physical access schedule of each parent and the counting of overnights spent by a child with each parent. Courts may deviate from standard guidelines when applying them would be unjust or inappropriate. Child support cannot be ordered to be paid by a parent retroactively for that period of time prior to the action filed by a parent seeking support from the other parent. Modifications Of Custody And Support Orders

Life circumstances change after initial custody and support orders are established. Maryland courts can modify existing orders when material changes in circumstances occur. Examples include parental relocation, changes in a parent’s living situation, evidence of neglect or abuse or significant changes in the child’s needs as they age.

Support modifications require showing material changes in either parent’s financial circumstances such as job loss, significant income increases or decreases or changes in childcare costs. Courts will not modify orders based only on temporary or minor changes.

Child support cannot be ordered for a period of time prior to an action filed by a parent seeking support. If a material of substantive change impacting the calculation of a child support obligation has occurred, the request for modification must be timely filed as there can be no retroactive changes for a period of time prior to the filing for a modification. Understanding this obligation and the rights for claiming a modification are important and should be acted upon in a timely manner.

Protective Orders And Custody Disputes
